1. Who we are
The Muslim Reset (the "Service") is operated by Nyiramana Florentine, a sole trader registered in Australia under ABN 91 653 561 235 ("we", "us", "our"). By creating an account or otherwise using the Service, you ("you") enter into a binding agreement with us on these terms.
2. Acceptance
By accessing or continuing to use the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm that you are at least 16 years old, or have the consent of a parent or guardian, and have authority to enter into this agreement.
3. The Service
The Muslim Reset is a digital wellbeing app for Muslims, providing tools such as salah tracking, an istighfar counter, journalling, goals, and community features. Features may evolve over time.
4. Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.
5. Acceptable use
You must not, and must not allow anyone else to:
- use the Service for any unlawful, fraudulent or harmful purpose;
- send spam, malware or other harmful content;
- infringe anyone's intellectual property or privacy rights;
- attempt to probe, scan, scrape, reverse engineer, or otherwise interfere with the security or integrity of the Service;
- harass, abuse or harm other members of the community;
- resell or redistribute the Service or any part of it without our written consent.
6. Your content
You retain ownership of any content you submit (journal entries, reflections, profile information). You grant us a limited, non-exclusive licence to host, store and process your content solely to operate and improve the Service for you.
7. Intellectual property
The Service, including all software, design, content we publish, and branding, is owned by us or our licensors and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial use during the term of your subscription.
8. Subscriptions, payments and refunds
Paid plans (currently $9/month or $99/year, USD) renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
9. Service availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may modify, suspend or discontinue features from time to time.
10. Suspension and termination
We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or seriously or repeatedly violate our policies. You may stop using the Service at any time by cancelling your subscription and closing your account.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is a wellbeing companion, not religious, medical or mental-health advice.
12. Limitation of liability
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, special, incidental, consequential, or punitive damages, including loss of profits, revenue, data or goodwill. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify us against any claims arising from your content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
14. Changes
We may update these Terms from time to time. If changes are material, we will let you know in the Service or by email. Continued use after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Australia. The courts of Australia have exclusive jurisdiction over any dispute, except where mandatory consumer law in your country of residence provides otherwise.
